11/18/14 Little Pond Financial Issues at Special Town Meeting

ARTICLE 1:

To see if the Town will vote to authorize the Board of Selectmen to petition the Massachusetts General Court for Special Legislation to authorize the Town to expend a sum of money as appropriated by Article 28 of the April 7, 2014 Annual Town Meeting for the purpose of reimbursing certain households within the Little Pond Sewer Service Area for the cost of acquiring and installing low pressure grinder pumps to connect to the sewer, or do or take any other action on the matter. On request of the Board of Selectmen.

VOTED:

By a unanimous vote, a quorum being present on Tuesday, November 18, 2014 the Town voted to authorize the Board of Selectmen to petition the Legislature for special legislation relative to construction of the sewer in the Little Pond Sewer Service Area for the following purpose and further to authorize the Board of Selectmen to accept changes recommended by Legislative Counsel or Bond Counsel to further effectuate the purposes of this article:

AN ACT TO AUTHORIZE THE BOARD OF SELECTMEN OF THE TOWN OF FALMOUTH TO EXPEND BORROWED FUNDS TO OFFSET CERTAIN COSTS ASSOCIATED WITH THE INSTALLATION OF LOW PRESSURE PUMPS ON PRIVATE PROPERTY IN THE LITTLE POND SEWER SERVICE AREA.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of same, as follows:

Section 1. Notwithstanding any general or special law to the contrary, the Board of Selectmen of the Town of Falmouth may expend a sum of money from the funds appropriated by Article 28 of the April 7, 2014 annual town meeting held in Falmouth and borrowed under authority of M.G.L. c. 44, s. 7(1) as authorized by said Article 28 for the purpose of reimbursements to certain property owners in the Little Pond Sewer Service Area for costs associated with the purchase and installation of low pressure pumps on private property necessary to connect each property to the Town’s sewer system. The Board of Selectmen may further determine the amount of such
payments provided, however, that the payments shall be the same for each private property and payments shall follow installation and inspection of the low pressure pump by the town wastewater superintendent.

Section 2: This act shall take effect upon its passage.

ARTICLE 2

To see if the Town will vote to authorize the Board of Selectmen to petition the Massachusetts General Court for Special Legislation
to authorize the Town of Falmouth to assess betterments in the Little Pond Sewer Service Area in such manner that households required to install low pressure grinder pumps will not bear a disproportionately high share of the total project cost, or do or take any other action on the matter. On request of the Board of Selectmen.

VOTED:

By a unanimous vote, a quorum being present on Tuesday, November 18, 2014 the Town voted Indefinite Postponement.
